It is well known that using combination hormonal contraceptives can elevate estrogen levels in the body, increasing a woman’s risk for developing serious blood clotting problems. However, the degree of risk varies depending on the exact type of combination hormonal contraceptive used. Prior to November 2005, the manufacturers of Ortho Evra® maintained that women who use the birth control patch are exposed to the same amount of estrogen as typical birth control pill users.
On November 10, 2005 the FDA publicly announced that women who use the Patch are exposed to about 60 percent more estrogen than women who take a typical birth control pill containing 35 micrograms of estrogen. At this time, the label on Ortho Evra® was updated to reflect the finding. An FDA press release that came out on November 10th said that it is still unknown whether Patch users are at greater risk for serious health problems than Pill users. However, the release said that, in general, increased estrogen exposure can heighten a woman’s risk for developing blood clots.
The potential dangers posed by the Ortho Evra® patch become clearer when it is compared to the birth control pill Ortho Tri-Cyclen®. Keep in mind that Ortho Tri-Cyclen® has six times the number of users as the Ortho Evra® patch:
RESEARCH: Even before the FDA updated the labeling for Ortho Evra®, Douglas & London had gathered evidence revealing that the Patch was more dangerous than the Pill and was reviewing thousands of pages available to us through the Freedom of Information Act.
FIRST NATIONWIDE CLASS ACTION: On August 18, 2005, Douglas & London filed the first nationwide Ortho Evra® class action against Ortho-McNeil Pharmaceutical, Inc., Johnson & Johnson Pharmaceutical Research & Development, L.L.C., and Johnson & Johnson on behalf of three women. Two of the women were birth control patch users who suffered life-threatening injuries; the third was a Patch user who died as a result of medical problems caused by the patch.
CASE REVIEW: Our firm continues to evaluate a number of other potential cases and is prepared to file more lawsuits. If you or a loved one suffered a serious injury that may have been related to Ortho Evra® use, contact us so we can determine if you have a viable lawsuit. If we accept your case, we will handle it from start to finish.
